We don’t simply look for the easy route so we can move on to the next case. Our approach treats your legal situation like your life depends on it. In many ways that’s true.

Misdemeanors and felonies have the potential for time behind bars and steep fines. Our first target is to get your charges dismissed altogether. When that’s impossible, we fight to have the charges reduced and mitigate potential sentences.

You will receive a thoughtful, targeted defense strategy whether you are charged with a misdemeanor or felony.

Misdemeanor Offenses in Mount Joy

Misdemeanors are less serious than felonies, but don’t let that differentiation fool you. Misdemeanors can carry significant consequences.

Misdemeanors are separated into three classifications:

  • First Degree. The most serious misdemeanor, first-degree misdemeanor convictions can mean up to five years in prison and fines up to $10,000. Assault, stalking, and repeat DUI are examples of this offense.
  • Second Degree. Up to two years behind bars and a fine of up $5,000 are possible when you are convicted of a second-degree misdemeanor. Offense examples include shoplifting, bigamy, and resisting arrest.
  • Third Degree. Disorderly conduct, writing a bad check, and criminal mischief are examples. A conviction can mean up to 1 year in jail and a fine of up to $2,500. An ungraded misdemeanor is treated as a third-degree offense.

Many people don’t realize that Pennsylvania requires mandatory minimum sentences for some misdemeanor offenses. A previous criminal record can elevate some lower-level offense to a felony. Plus, even the least-serious misdemeanor can lead to time behind bars.

Don’t assume anything in a misdemeanor case. You need the experience and determination of one of our Mount Joy criminal defense lawyers at your side.

Felony Offenses in Mount Joy

Like misdemeanors, felonies are also classified according to the seriousness of the crime:

  • Felony Murder. First-degree felony murder carries the death penalty. Other murder offenses can carry between 40 years and life in prison.
  • First Degree. These felonies include aggravated assault with a deadly weapon, kidnapping, and rape. Sentences range from 10 to 20 years in prison and a fine of up to $25,000.
  • Second Degree. The consequences of a second-degree conviction are 5 to 10 years in prison and a fine of up to $25,000. Examples of these crimes include sexual assault, aggravated assault, and burglary (with no one inside the structure).
  • Third Degree. Some gun crimes, possession of child pornography, and bribery are examples. Prison sentences range between 3.5 and 7 years with a fine of up to $15,000. Any ungraded felony is treated as a third-degree offense.

Any convictions can continue to affect your life even after you have completed any sentence. You can be denied admission to school, barred from federal benefits, and turned down for housing and jobs. You can lose the right to own a firearm or hold a professional license.
