Pennsylvania DUI Laws & Penalties
Drivers who are at least 21 years of age can be charged with a DUI for driving with a blood alcohol content (BAC) level of 0.08 percent or more. Commercial drivers can get charged for drunk driving with a BAC of at least .04, while drivers under 21 can face DUI penalties with a BAC of at least .02.
A first DUI conviction is punishable by a mandatory minimum probation term of six months, a maximum $300 fine, community service, and alcohol safety school. However, if a person has a BAC level of .10 or higher, his/her driver’s license will be suspended for up to 18 months.
A second DUI conviction carries a maximum six-month jail term (with a minimum of five days), a fine of up to $2,500, and driver’s license suspension for up to 12 months. A third DUI conviction carries a maximum two-year jail, a fine not exceeding $5,000, and driver’s license suspension for up to 12 months.
